1. ACCEPTANCE OF TERMS OF SERVICE

DCP2GO.com is owned and operated by iNFOCARTOON d.o.o with its registered address at Na tezi 4, 1000, Ljubljana, Slovenia (“iNFOCARTOON”)  with  Registration number 6154930000 and Tax number SI 57604657,  which will be referred to as “We”, “our” and “us” in this Terms of Service.

DCP2GO.com provides the following services to you (“User”) subject to the following Terms of Service (Terms), which may be updated by DCP2GO.com from time to time without notice to User, the most current versions of which will always be available on our website at https://www.dcp2go.com/terms-and-conditions/

By placing an order at DCP2GO.com, User accepts and agrees to be bound by the terms and provisions of these Terms. If you have any questions or concerns about any of these terms, please do not hesitate to contact us prior to placing an order.

2. TERMS OF PAYMENT

All orders must be paid in full before any material will be released.

3. PRICE POLICY

The prices posted on the website are final. There are no hidden costs or subsequent payments. Before placing an order, User may check the final price of our services at any time.

4. TURNAROUND TIMES

• Standard: 4-7 Business Days
• Rush: 24 hours

Turnaround times are calculated from receipt of all required master materials until the finished material(s) are ready to be delivered to User.  Due to high workload volumes during certain peak times of the year, our Rush turnaround time may vary. During certain periods »Rush expedited turnaround« may not be available. When User opts for “Rush” additional service, they will be notified in advance when DCP2GO.com is not able to ensure their desired turnaround time. In this case, User may decide to cancel the order and will be reimbursed the entire payment by DCP2GO.com. If not, User is entitled to compensation for each hour of delay as is stated below:

5. CONTENT STORAGE

• Standard: 7 Business Days
• Premium : 365 Business Days (1 Year)

After making the final DCP, DCP2GO.com shall notify User about the order being complete by sending them an e-mail or SMS message. Depending on the previously chosen type of delivery, User may download the final master DCP copy of the film from the DCP2GO.com website. Access to download will be enabled via an encrypted link send exclusively to User who placed the order.

a) When placing a standard order, the link to download the final product is available for 7 working days. During this period, User has to ensure the transfer of digital contents from the DCP2GO.com website either to themselves or a third party. If User fails to download the final product within 7 days due to known or unknown reasons, they might use a web form to request a new link that would enable them to transfer the final product. DCP2GO.com shall in no event be held responsible if User fails to acquire the final product within the contract period. Neither shall DCP2GO.com be obliged to store final film copies after the agreed period of time has passed. In the event that DCP2GO.com no longer possesses a digital copy of the final product after the agreed time has passed, User shall have to place a new order for the service (which shall be considered a new order), and shall have to pay for the total service of making a DCP based on the new order.

b) When placing a Premium order, DCP2GO.com shall store the final product for the period of one year (365 days), during which time User may use the link for downloading the final product or submitting it to festivals, cinemas or other venues. DCP2GO.com shall ensure undisturbed transfers in cooperation with an external operator providing DCP2GO.com with the infrastructure for storage and digital distribution based on high transfer speeds. DCP2GO.com shall in no event be held responsible if User fails to acquire the final product within the contract period. Neither shall DCP2GO.com be obliged to store final film copies after the agreed period of time has passed. In the event that DCP2GO.com no longer possesses a digital copy of the final product after the agreed time has passed, User shall have to place a new order for the service (which shall be considered a new order), and shall have to pay for the total service of making a DCP based on the new order.

In no case shall DCP2GO.com be held responsible if the link for downloading the final product appears online. User shall have to ensure the proper use of the link and its distribution online. If abuse of the link seems to have happened, User may contact DCP2GO.com and we will make sure to replace the link with a new one in the shortest time possible.

6. COPYRIGHT

DCP2GO.com will only work on submitted material if we fully believe in good faith that User has, or has obtained, all necessary rights for the mastering, duplication, encryption or de-encryption, and exhibition of said materials. Prior to starting or releasing work, DCP2GO.com may ask User to provide additional backup material, and/or written warrants with regard to their rights and interests in a project. DCP2GO.com reserves the right to refuse or cancel any project, upon a full refund and return of any materials, at any time, for any reason.

DCP2GO.com respects the intellectual property rights of others and expects users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information pursuant to the applicable legislation:

• a physical or electronic signature of the copyright owner or a person authorized to act on their behalf,
• identification of the copyrighted work claimed to have been infringed,
• identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material,
• your contact information, including your address, telephone number, and an email address,
• a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law, and
• a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

7. ADULT CONTENT

If User’s content contains pornographic or other adult images or themes, additional terms or restrictions may apply. Please contact DCP2GO.com for additional information.

8. CANCELLATION

Upon placement of an order by User, but prior to DCP2GO.com receipt of all necessary material(s), orders are subject to a 30% cancellation fee. After receipt of all necessary material(s), orders cannot be cancelled.

9. GUARANTEES / REFUNDS

DCP2GO.com warrants that all DCPs created by us shall be fully DCI compliant and are 100% guaranteed to ingest and playback on any modern DCI compatible Digital Cinema Media Server. User shall only be entitled to refunds or exchanges when an error or oversight made by DCP2GO.com has led to a package being non-compliant, and upon return of any such materials to us for further inspection. Owing to the nature of our services we can not offer any refunds or exchanges due to change in exhibition plans, errors in originating master material(s), damage due to mishandling or misuse of material(s) by User or third-party exhibition venues, future equipment or DCP specification changes, incorrect encryption information being provided by User or third-party exhibition venues, physical damage to media or equipment incurred during shipping, or any other issue not under the control of DCP2GO.com.

10. YOUR ACCOUNT

• Creation of Account:

You must complete the registration process by providing DCP2GO.com with current, complete, and accurate information as prompted by the applicable registration form.

• Responsibility for Account:

You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify DCP2GO.com immediately of any unauthorized use of your account or any other breach of security.

• Liability for Account Misuse:

DCP2GO.com will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You could be held liable for losses incurred by the DCP2GO.com or another party due to someone else using your account or password.

• Use of Other Accounts:

You may not use anyone else’s account at any time, without the permission of the account holder.

11. ACCOUNT SECURITY

DCP2GO.com is concerned for the integrity and security of your personal information. However, DCP2GO.com cannot guarantee that unauthorized third parties will never be able to defeat the Site’s security measures or use any personal information you provide to us for improper purposes. You acknowledge that you provide your personal information at your own risk.

12. TRADEMARKS

DCP2GO.com name and logo are trademarks of the iNFOCARTOON d.o.o., and may not be copied, imitated or used, in whole or in part, without the prior written permission of iNFOCARTOON d.o.o. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks, and trade dress of the DCP2GO.com, and may not be copied, imitated, or used, in whole or in part, without prior written permission from the iNFOCARTOON d.o.o.,

13. USE OF SITE

You may not engage in any of the following prohibited activities:

• copying, distributing, or disclosing any part of the Site in any medium, including without limitation by any automated or non-automated “scraping”,
• using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Site,
• transmitting spam, chain letters, or other unsolicited email,
• attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Site,
• taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on Site infrastructure,
• uploading invalid data, viruses, worms, or other software agents through the Site,
• collecting or harvesting any personally identifiable information, including account names, from the Site,
• using the Site for any commercial solicitation purposes,
• impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity,
• interfering with the proper working of the Site,
• accessing any content on the Site through any technology or means other than those provided or authorized by the Site, or
• bypassing the measures we may use to prevent or restrict access to the Site, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.
